Terms and Conditions

1. About Tubelight Films

Tubelight Films (“Tubelight Films”, “we”, “us” or “our”) is a television commercial (TVC) and audiovisual production studio. Our website, https://tubelightfilms.com, showcases selected productions, commercials, films and related creative work.

These Terms & Conditions govern your access to and use of our website, including our video portfolio, showreels, project descriptions, production stills, images and other published materials (collectively, the “Portfolio”).

By accessing or using this website, you agree to these Terms & Conditions, subject to applicable law.

2. Purpose of the Portfolio

Our Portfolio is intended to demonstrate our production experience, filmmaking capabilities, technical execution and professional contributions to advertising and audiovisual projects.

The Portfolio may feature television commercials, digital advertisements, branded films and other productions undertaken in collaboration with brands, clients, advertising agencies, directors, production partners, performers and creative professionals.

Works are displayed for professional, informational and promotional purposes, subject to the permissions, contracts, licences and legal rights applicable to each production.

3. Intellectual Property and Ownership

The display of a work in our Portfolio does not mean that Tubelight Films owns every intellectual property right in that work.

All copyright, trademarks, designs, creative works, performances and other intellectual property rights remain with their respective lawful owners, creators, rights holders or authorised assignees, as determined by applicable agreements and law.

Depending on the particular production and the rights concerned, ownership or control may rest with:

  • The commissioning client, brand or advertiser.
  • An advertising agency or creative agency.
  • A director, writer, cinematographer, photographer, editor, composer or other creative contributor.
  • A producer, production company or another party holding contractual rights.
  • The owner or authorised licensor of music, sound recordings, stock footage, artwork, graphics, fonts, performances or other third-party materials.
  • Any other person or entity legally entitled to the relevant rights.

Different elements of a single commercial may have different owners, licence conditions or usage restrictions.

Tubelight Films does not claim ownership of a client's brand identity, logo, trademark, script, concept, music, artwork, footage or other material merely because it participated in producing or displaying the work.

Any rights Tubelight Films holds in its original contributions, production materials, showreels, behind-the-scenes content or other original work remain subject to the relevant agreements and applicable law.

4. Authorisation to Showcase Productions

Tubelight Films showcases selected productions where it has obtained, or reasonably relies upon, the necessary permission, contractual authorisation, licence or other lawful basis for the relevant display.

Permission to showcase a production may be subject to restrictions concerning duration, territory, platform, confidentiality, exclusivity, campaign embargoes, client approval or permitted formats.

The inclusion of a commercial in our Portfolio does not represent that we own all underlying rights or have unrestricted permission to use every component of that commercial for every purpose.

Where an applicable permission expires, is withdrawn, is challenged, or is found to be insufficient, we may review, restrict, replace or remove the relevant material, subject to our contractual and legal obligations.

Nothing in these Terms & Conditions grants Tubelight Films rights that it does not otherwise lawfully hold.

5. Brands, Trademarks and Attribution

All brand names, logos, trademarks, service marks, product names and other brand identifiers displayed on this website belong to their respective owners.

They may appear to identify the relevant client, brand, product, campaign or production.

Unless expressly established by an actual agreement or other reliable basis, their appearance does not imply that:

  • Tubelight Films owns the relevant brand or trademark.
  • The featured brand endorses or sponsors Tubelight Films.
  • The brand has an ongoing commercial relationship with Tubelight Films.
  • Tubelight Films owns the underlying advertising concept or every creative element.
  • The Portfolio work is an official statement by the featured brand about Tubelight Films.

Project descriptions and credits are provided where available and appropriate. Credits may be corrected or updated if new information becomes available. A missing or incorrect credit does not determine legal ownership.

6. Third-Party Videos and Embedded Content

Our website may display videos hosted on third-party platforms, videos hosted directly on our own website infrastructure, or a combination of these methods.

Third-party video platforms operate independently and may apply their own terms, privacy policies, cookie practices and technical requirements. Interacting with an embedded player may result in information being processed by the relevant platform.

The availability of a video on our website does not grant visitors ownership of, or permission to reuse, the video or any element within it.

Access to a third-party player may also be subject to that provider's terms and technical availability.

7. Restrictions on Portfolio Use

Unless expressly authorised by the relevant rights holder or permitted by applicable law, visitors must not:

  • Download, reproduce, redistribute, republish, broadcast or commercially exploit Portfolio materials.
  • Copy, edit, remix, adapt or create derivative works from our videos or other creative materials.
  • Extract footage, music, artwork, graphics, photographs or other elements for use in another production, advertisement, campaign or publication.
  • Remove copyright notices, credits, watermarks or rights-management information.
  • Present a featured production as their own work.
  • Use Portfolio materials in a way that infringes intellectual property, privacy, publicity, contractual or other legal rights.
  • Misrepresent an association with Tubelight Films, a featured brand or another rights holder.

Viewing or accessing a video through our website does not constitute a licence to download, reuse, modify or exploit that video or its component materials.

Any proposed reuse must be supported by all necessary permissions, licences or other lawful authority.

8. Copyright Concerns and Removal Requests

We respect the intellectual property and legitimate rights of clients, brands, agencies, creators, performers and other rights holders.

If you believe that a work displayed in our Portfolio infringes your rights, exceeds an applicable permission or should not be displayed, please contact us with:

  • Your name and contact details.
  • The URL or identification of the relevant work.
  • A description of the right or interest affected.
  • The reasons for your concern.
  • Relevant supporting documents or evidence, where available.
  • The action requested, such as correcting a credit, restricting access or removing the work.

We may request additional information to verify your identity, rights or authority to submit the request.

We will review genuine complaints in good faith and take appropriate action where warranted. This may include temporarily restricting access while we investigate the matter.

A request does not automatically establish infringement or guarantee removal. We will consider relevant permissions, contracts, ownership evidence and applicable law before determining the appropriate response.

9. Website Accuracy and Availability

We endeavour to keep our website and Portfolio reasonably accurate and available. However, project information, credits, descriptions, links and embedded media may occasionally be incomplete, outdated or unavailable.

We may update, reorganise, restrict or remove website content where reasonably necessary, subject to our contractual and legal obligations.

Portfolio materials are provided to demonstrate previous work and production experience. They do not guarantee any particular commercial result, advertising performance, audience engagement or outcome for future projects.

Any commissioned work, quotation or production engagement will be governed by the applicable written agreement.

10. Third-Party Websites and Services

Our website may link to external websites or use third-party media players and services. Those services are not necessarily operated or controlled by Tubelight Films.

Their content, availability and data practices are governed by their respective terms and policies. Visitors should review those policies when accessing external services.

Nothing in this section excludes any responsibility that applicable law requires Tubelight Films to retain.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Tubelight Films shall not be liable for indirect, incidental, special or consequential losses arising from access to or use of this website, reliance on Portfolio descriptions, or the temporary unavailability of content.

Nothing in these Terms & Conditions excludes or limits liability that cannot lawfully be excluded or limited, including any liability arising from fraud, wilful misconduct or other matters for which an exclusion is prohibited by law.

These Terms & Conditions do not override a binding client or production agreement, alter the lawful ownership of intellectual property, or eliminate any liability imposed by applicable law.

12. Unauthorised Use and Claims

A person who unlawfully reproduces, distributes, modifies or commercially exploits Portfolio materials may be responsible for consequences arising from their conduct under applicable law.

Tubelight Films will not treat a visitor as responsible for an infringement merely because the visitor viewed the website or because a third-party work appears in our Portfolio.

Responsibility for a claim will depend on the relevant facts, applicable law and any binding agreement.

13. Changes to These Terms

We may revise these Terms & Conditions to reflect changes to our website, Portfolio practices, business operations or applicable law.

The updated version will be published on this page with a revised “Last Updated” date. Any notice or consent required by applicable law will be provided where applicable.

14. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of India, subject to applicable legal principles.

Disputes shall be brought before the competent courts at [Insert Agreed City and State], India, to the extent that such jurisdiction is legally valid and enforceable.
